LEGAL SERVICES FOR REALTORS AND BROKERS

By PRADEEP CHAND, Founding Partner

Licensed professionals are required to adhere to a higher standard of care to the public they serve. Their occupations are commonly monitored and regulated by governing bodies that investigate accusations of misconduct and other improper behaviour. The Real Estate Council of Ontario (“RECO”) is the body that enforces and governs the rules that real estate salespeople, brokers and brokerages have to abide by. This body regulates through the powers granted to it by the Province of Ontario under the Real Estate and Business Brokers Act, 2002, S.O. 2002, c. 30, Sched. C (“REBBA”), as well as their individual Code of Ethics.

At Chand & Co., we represent agents and brokers who have been charged under REBBA, had an adverse decision made against them with respect to their licence, or are being investigated or responding to complaints made to RECO. We are familiar with all aspects of RECO’s disciplinary procedures and routinely represent registrants before RECO’s discipline committee, the Licence Appeal Tribunal and the Provincial Offences Court.

Our years of litigation experience enable us to ensure your rights as a real estate agent or real estate broker are protected. The penalties real estate professional can face range from a mere warning, to significant fines and/or a prison term up to two years for breaching provisions of REBBA as well as possible suspensions or revocation of your licence. When you are facing these types of allegations, the long-term effects can have drastic implications for you and your family. This can also impact your professional status and other business relationships you have spent years developing.

As regulated and licensed professionals ourselves, we understand the environment licenced professionals operate within and how to manage the governing bodies and public expectations. At Chand & Co. our top priority is to protect your licence, reputation and your livelihood. We provide services throughout Ontario and are available 24/7 to take your calls. If you or a loved one is facing a complaint, call our office today at 416-583-2377 for a consultation and let our lawyers work for you.
