Domestic Contracts

A domestic contract is a legally binding agreement between parties that outlines personal, family, property, and relationship matters. In Ontario, five types of domestic contracts exist:

  • Marriage Contracts (Prenuptial Agreements): Outlines asset division, financial responsibilities, and spousal rights in case of separation or death.
  • Separation Agreements: Establishes terms regarding property division, decision-making responsibilities, parenting time, and financial support upon separation.
  • Cohabitation Agreements: Protects financial interests and clarifies property division for unmarried partners living together.
  • Paternity Agreements: Ensures financial and parenting obligations for unmarried parents separating after having a child.
  • Family Arbitration Agreements: Allows parties to settle disputes privately through arbitration instead of court proceedings.

Domestic contracts offer control, predictability, and financial security. However, they must be written, signed, and witnessed to be legally enforceable. Our family lawyers can draft, review, or modify domestic contracts to reflect your needs while ensuring compliance with Ontario law.

Uncontested Divorce

An uncontested divorce occurs when both spouses agree to end their marriage without disputes over property division, support, or parenting arrangements. To file for divorce in Ontario, the following criteria must be met:

  • You must be legally married.
  • You must have lived in Ontario for at least one year.
  • You must prove marriage breakdown through:
    1. One year of separation;
    2. Adultery (with supporting evidence); or
    3. Physical or mental cruelty making cohabitation intolerable.

We assist with preparing and filing divorce applications, ensuring all legal requirements are met efficiently and without unnecessary complications.

Child and Spousal Support

In Ontario, child and spousal support obligations are determined by law. The Child Support Guidelines set the amount of child support based on the payor’s income and the number of children. Spousal support, on the other hand, depends on factors such as the length of the marriage, financial need, and ability to pay. We assist clients in drafting and enforcing fair and reasonable support agreements.

Frequently Asked Questions (FAQs)

1. What are the benefits of a domestic contract?

Domestic contracts provide certainty regarding financial and property matters, reduce conflicts, and prevent costly legal battles in the future. They offer security for both partners and allow for personalized arrangements that suit unique family dynamics.

2. Can a domestic contract be challenged in court?

Yes, courts may set aside a domestic contract if:

  • One party failed to disclose significant financial details;
  • The contract was signed under duress or coercion;
  • The agreement is unconscionable and heavily favours one party.

3. What is the difference between contested and uncontested divorce?

An uncontested divorce occurs when both spouses agree on all terms, making the process faster and less expensive. A contested divorce involves disputes requiring court intervention, prolonging resolution and increasing legal costs.

4. Do I need a lawyer for an uncontested divorce?

While not required, having a lawyer ensures that your divorce paperwork is completed correctly and your rights are protected. A lawyer can also help with any additional agreements, such as child or spousal support arrangements.

5. How is child support calculated?

Child support is determined using the Federal Child Support Guidelines, which consider the payor’s income and the number of children. It is a legal obligation and must be paid unless a court order states otherwise.

6. Can I change the amount of child or spousal support?

If circumstances change (e.g., job loss, income increase, or new financial obligations), you can apply for a Motion to Change with the court. The Family Responsibility Office (FRO) does not have the authority to modify support amounts.

7. How can I ensure my separation agreement is enforceable?

A separation agreement should be in writing, signed by both parties, and witnessed. Each party should obtain independent legal advice to ensure fairness and avoid challenges in court.

8. What happens if my spouse refuses to pay support?

Support orders are enforced by the Family Responsibility Office (FRO) in Ontario. If payments are not made, the FRO can garnish wages, suspend driver’s licenses, and take other enforcement actions.

9. Can I handle my divorce or separation without going to court?

Yes, many uncontested family law matters can be resolved through agreements such as separation agreements, mediation, or arbitration, avoiding costly and time-consuming court battles.

10. How long does an uncontested divorce take?

The timeline varies, but an uncontested divorce in Ontario typically takes 4 to 6 months from filing to receiving the divorce certificate, provided all paperwork is correctly filed.
